Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "user") and Magnatic, a business established at Teollisuuskatu 3B, 00510 Helsinki, Finland ("Magnatic", "we", "us"). By accessing magnatic.life or purchasing the report, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.

1. The Services

Magnatic provides an online behavioral self-assessment and a personalized digital report (collectively, the "Services"). The Services are delivered electronically as a one-time digital product.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract. By using the Services you represent that you meet these requirements.

3. Not professional advice

Magnatic is provided for informational, educational, and self-reflection purposes only. It is not medical, psychological, psychiatric, therapeutic, legal, or financial advice, and does not establish any professional relationship. If you are experiencing distress or a mental-health crisis, contact a qualified professional or your local emergency services.

4. Account, accuracy, and your responsibilities

• You agree to provide accurate, current information (including a working email address) so we can deliver your report.
• You are responsible for keeping the access link to your report confidential.
• You are responsible for how you act on any insights in the report.

5. Orders, pricing, and payments

• Prices are shown in the checkout in the listed currency and include applicable VAT where required.
• Payment is processed by Stripe. By placing an order, you authorize us to charge the payment method you provide.
• The contract is concluded when we confirm your order by email and access to your report is granted.
• We may refuse or cancel an order in cases of suspected fraud, pricing errors, or violation of these Terms.

6. Digital content and right of withdrawal

The report is digital content that is delivered immediately upon purchase. In accordance with Article 16(m) of EU Directive 2011/83/EU on Consumer Rights, and the corresponding provisions of the Finnish Consumer Protection Act (Chapter 6, Section 16), you expressly acknowledge and agree that:

• performance of the contract begins immediately upon purchase, and
• you thereby lose your statutory 14-day right of withdrawal once access to the report is provided.

If your report is genuinely defective or undelivered, contact support@magnatic.life and we will resolve the issue.

7. License and intellectual property

All content on the Services, including the assessment, report, copy, design, code, and trademarks, is owned by Magnatic or its licensors and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use your report for your own personal, non-commercial use. You may not:

• resell, sublicense, or distribute the report or any excerpts;
• copy, scrape, or republish the Services or any part of them;
• reverse-engineer, decompile, or attempt to extract source code or model prompts; or
• use the Services to train or fine-tune any machine-learning model.

8. Acceptable use

You agree not to:

• use the Services for any unlawful purpose;
• attempt to interfere with the security or integrity of the Services;
• submit content that is harmful, defamatory, or violates the rights of others;
• abuse, threaten, or harass other users or our team.

We may suspend or terminate access for any breach of this section without refund.

9. Third-party services

The Services rely on third parties (payments, hosting, email, AI providers, analytics). We are not responsible for the acts, omissions, or content of third parties. Their terms and privacy policies apply to their respective services.

10. Disclaimers

To the maximum extent permitted by law, the Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or produce any particular outcome.

11. Limitation of liability

To the maximum extent permitted by law, Magnatic and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Services. Our aggregate liability for any claim relating to the Services shall not exceed the amount you paid us for the report in the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law, including liability for gross negligence, willful misconduct, or death or personal injury caused by negligence.

12. Indemnification

You agree to indemnify and hold harmless Magnatic from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

13. Privacy

Your use of the Services is also governed by our Privacy Policy and Cookie Policy, which are incorporated by reference.

14. Changes to the Services or Terms

We may modify or discontinue all or part of the Services at any time. We may also update these Terms; the "last updated" date reflects the current version. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of Finland, without regard to its conflict-of-laws rules. Any dispute shall be submitted to the exclusive jurisdiction of the District Court of Helsinki (Helsingin käräjäoikeus), Finland, unless mandatory consumer-protection law grants you the right to sue in the courts of your country of residence.

Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Miscellaneous

• If any provision of these Terms is held invalid, the remaining provisions remain in force.
• Our failure to enforce any right is not a waiver of that right.
• You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
• These Terms (together with the Privacy Policy and Cookie Policy) constitute the entire agreement between you and Magnatic.
